I. Introduction

The online store available at https://bognaskin.com is owned by Bogna Skin spółka z ograniczoną odpowiedzialnością with its registered office in Miedziana Gora (address: Tumlin-Podgród 52a, 26-085 Miedziana Gora) entered into the Register of Entrepreneurs of the National Court Register, for which the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Department of the National Court Register keeps the registration files under the number KRS 0000835835, with the share capital of 5.000 PLN, holding the NIP: 9592032730 and REGON: 385852644.

The customer of the BOGNA SKIN online store (“Customer”) may be a natural person with full legal capacity and a legal entity, as well as an organizational unit without legal personality, which is granted legal capacity by law.

A customer of the BOGNA SKIN online store may be both consumers within the meaning of the Act of 23 April 1964. – Civil Code (i.e. Journal of Laws of 2017, item 459; hereinafter referred to as the “Civil Code”), as well as entrepreneurs within the meaning of the Act of 6 March 2018. – The right of entrepreneurs (Journal of Laws of 2018, item 646).

The BOGNA SKIN Internet store allows customers to familiarize themselves with the commercial information and offer of BOGNA SKIN products and enables their purchase, according to the provisions of the Regulations.

The services provided by BOGNA SKIN within the framework of the online store consist in providing customers with the possibility of using the functions available in it, in particular:

data editing;
configuration and placing orders;
an insight into the history of orders;
making complaints;
communication with a consultant.

BOGNA SKIN provides services within the framework of an Internet store within the European Union.

The regulations specify:

types, scope and conditions of providing services by BOGNA SKIN electronically within the framework of the online store,
technical requirements necessary to cooperate with the ICT system used by BOGNA SKIN within the framework of an online store,
the complaint procedure,
principles relating to personal data protection.

Acceptance of the Regulations by the Client is tantamount to making statements of the following content:

I have read the Regulations and accept their provisions;
I have voluntarily started to use the services of the online store;
the data contained in the order forms, registration or contact process are true;
I agree to the processing of my personal data, provided in the registration or contact form, for the purpose necessary to establish, shape the content, change or terminate the agreements concluded with BOGNA SKIN within the framework of the online store and to carry out the order placed by BOGNA SKIN;

The customer may also agree to receive system information, messages from BOGNA SKIN and information about impediments, changes or technical interruptions to the operation of the online store, as indicated in the registration or contact form.

BOGNA SKIN makes the Terms and Conditions available to customers on the https://bognaskin.com website on a continuous basis and free of charge, in a manner that makes it possible to obtain, reproduce and record the content.

In matters not regulated by the Regulations, the provisions of the Civil Code and the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2019, item 123 as amended) shall apply to the provision of services by electronic means, in particular to the submission of declarations of will in electronic form.

In case of any doubts, Polish law shall apply to all issues resulting from the application of these Regulations, as well as in matters not regulated herein.

To agreements concluded with Clients making purchases through the online store, as well as to all claims related to these agreements, Polish law shall apply.

II. Definitions

Customer – a natural person, legal entity or an organizational unit without legal personality, to which separate regulations grant legal capacity, making purchases through the BOGNA SKIN online store.

Consumer – a customer who is a natural person making a legal transaction with BOGNA SKIN within the online store that is not directly related to its business or professional activity.

Product/goods – an item presented in the area of the BOGNA SKIN online store for sale.

Distance contract – a contract concluded with a consumer within an organized system of concluding distance contracts, without the physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract, The distance contract is not a contract concluded in BOGNA SKIN premises.

III. Provision of services within the BOGNA SKIN online store

The following technical requirements are required to use the services of the online store:

connection to the Internet,
having an updated and efficient internet browser by the Client: Internet Explorer, Chrome, Mozilla, Opera, Safari with JavaScript and Cookies enabled; for problems resulting from the use of browsers that do not meet this requirement, BOGNA SKIN is not responsible, 3) The Customer has an active and correctly configured e-mail account.

The Customer is obliged to use BOGNA SKIN’s online store in a manner consistent with the Regulations, good manners and Polish law. In particular, it is forbidden:

use any personal data, company or other untrue markings that are not in accordance with the Regulations,
violating the confidentiality of correspondence,

violate in any way the intellectual property rights of third parties, including copyright or related rights, and personal rights of third parties, including the right to the image, good name, honor (in particular, it is prohibited to disseminate the image of persons without the appropriate consent of those persons, if required by law).

IV. Customer data

The Customer is obliged to inform BOGNA SKIN about any change in the data that individualizes him/her, as well as about an error in the content of the data that he/she made available during registration or order placement, in particular his/her name, company, address of residence, registered office (in the case of entrepreneurs), e-mail address.

The individualizing data made available by the Customer during registration or order placement shall be deemed to be current until the Customer makes an authorized change or correction thereof. The Customer shall be obliged to repair any damage that BOGNA SKIN may suffer as a result of the Customer’s failure to change or correct its individualising data.

BOGNA SKIN reserves the right to verify statements made by the Customer, especially the Customer’s individualised data, and may request confirmation in the form specified by BOGNA SKIN.

BOGNA SKIN may refrain from providing services to the Customer if the Customer does not confirm the truthfulness of the statements made by the Customer, as well as if their truthfulness raises justified doubts, until they are removed.

BOGNA SKIN allows for the purchase of goods such as cosmetic products and care and personal accessories within the online store.

The customer of the BOGNA SKIN webshop, after entering https://bognaskin.com/, has the opportunity to view the commercial information and product specifications of BOGNA SKIN and, as part of the webshop function, to select and place orders to purchase selected BOGNA SKIN products.

BOGNA SKIN allows the customer to familiarize himself or herself with commercial information and product specifications, in particular by providing a description and information about the type, name of the product, its composition, size, colors, availability, delivery date, price and product photos. In order to become acquainted with a specific product specification, the Customer has the opportunity to contact a BOGNA SKIN consultant via e-mail at hello@bognaskin.com.

Commercial information placed on the store’s website does not constitute an offer within the meaning of Article 66 of the Civil Code, but constitutes an invitation to submit offers, even if the information contains a unit price of the product.

V. Orders and sales

The purchase of BOGNA SKIN products in the online store can be done using the following purchase procedures:

  • using the Customer’s “Basket”,
  • using the “Ask for product” form (Product to order),
    by placing an order via e-mail to BOGNA SKIN: hello@bognaskin.com.

The prices of goods visible in the Shop are total prices for the goods, including VAT.

V. Purchase using the Client’s “Cart” Purchase using the Client’s “Cart”

In order to purchase the BOGNA SKIN products, the customer, after reading the commercial information and product specifications, and in the situation where it is possible to configure the product properties, clicks on the “Add to cart” option available on the page.

The customer’s shopping cart contains a list of products selected by the customer, which can be purchased in further steps in the BOGNA SKIN online store. The Customer’s basket also contains an indication of dimensions, quantity, unit price of the product and total price in case of ordering more products.

In the Customer’s basket it is possible to change the quantity of ordered products and remove them from the basket.

After entering the product into the basket, the customer can continue shopping in the online store or go directly to the product purchase procedure. Entering a product into the basket does not mean automatic purchase of the product.

Some BOGNA SKIN products, the information and specification of which is given on the pages of the online store, are not available for sale within the services of the online store. Such products cannot be placed in the shopping cart. The product card of this type of products includes information about availability only in BOGNA SKIN sales points through the online store. The list of BOGNA SKIN points of sale is available at bognaskin.com

After clicking the “Order” option in the “Shopping cart” function, the Customer, in order to continue the purchase procedure, should fill in order forms requiring the data necessary for BOGNA SKIN to complete the order, and in particular the data of the Customer (payer), including the Customer’s e-mail address, data for the delivery of the product, method of delivery (courier, self-collection) and should choose the method of payment (transfer, cash on delivery, payment using Dotpay online payment system). Providing data marked with * (asterisks) is obligatory; lack of such data makes it impossible to purchase BOGNA SKIN products within the online store. Choosing personal collection, the Customer can pay for the order by bank transfer or using Dotpay account.

After the procedure specified in paragraph 6 above is completed, the Customer will receive a summary of purchases, indicating in particular the name and quantity of products to be purchased, their unit price, total price of the order, ways and costs of delivery. At the same time the Customer will have the opportunity to become familiar with the full content of the Regulations. Making a purchase requires confirmation of knowledge and acceptance of the Regulations.

In order to place an order and pay for it, the Customer, after verifying the correctness of the purchase summary, should accept the Terms and Conditions and click on the button “Order with payment obligation”, which is tantamount to making a purchase offer by the Customer. By choosing the above option, the Customer who is a consumer confirms that he knows that the order entails an obligation to pay.

In the case of the option of payment by bank transfer, after accepting the Regulations and clicking on the option “Order with obligation to pay”, the Customer will be redirected to the website of the payment operator to pay for the order. The payment order is executed in accordance with the payment terms and conditions of the payment operator.

In the case of the Dotpay payment option, after accepting the Terms and Conditions and clicking the option “Order with obligation to pay” the Customer will be redirected to the website http://www.dotpay.pl/ in order to pay for the order. The payment order is executed by Dotpay in accordance with the regulations available for download on the above mentioned website.

In case of the option of payment on delivery, the payment of the order takes place at the latest at the moment of delivery by courier to the place indicated by the Customer. BOGNA SKIN shall hold off on releasing the product to the Customer until the Customer fully pays for the order.

After the system of the online store receives the order and after the payment has been made by the Customer, an automatic e-mail will be sent to the Customer’s e-mail address confirming receipt of the order by BOGNA SKIN and informing that the order will be confirmed in the next e-mail.

In the case of an order being processed, BOGNA SKIN, after checking its correctness and availability of products, confirms acceptance of the order for processing by a separate e-mail and changes the status of the order to “Accepted for processing”. This message contains at least BOGNA SKIN’s statement of receipt of the Order and confirmation of the conclusion of the Sales Agreement, which is tantamount to confirmation of the conclusion of a distance contract in the case of customers who are consumers. As soon as the Customer receives the above e-mail message, a Sales Agreement is concluded between the Customer and BOGNA SKIN.

Along with the confirmation of the order being processed, BOGNA SKIN sends the Customer the Terms and Conditions together with a specimen statement of withdrawal from a remote or off-premises contract concluded with a consumer. Sending a model statement of withdrawal cannot be construed as granting a right of withdrawal to a Customer who is not a consumer.

BOGNA SKIN will immediately inform the Customer about the impossibility of completing the order in the event of circumstances causing such impossibility. In such a situation, the price paid will be immediately returned to the Customer in full.

An offer submitted by the Customer and not confirmed by BOGNA SKIN within 72 hours shall cease to bind the Customer.

BOGNASKIN reserves the ownership of the products sold until the Customer has paid the full sales price.

VI. Purchase using the “Ask for product” form

Some of BOGNA SKIN’s products available as part of the commercial information contained on the store’s website The customer can purchase only by using the “Ask for product” form (Product to order”), if such a form is made available by BOGNA SKIN.

Some of the BOGNA SKIN products available for purchase using the “Ask for Product” form show the individual properties specified by the Customer in the order form submitted by him or by individual arrangements with a BOGNA SKIN consultant (Product configured).

The Customer fills in the order form, in which he or she selects or defines the type of product he or she wants to purchase and, in the case of such an option, individualizes its properties using the IT tools of BOGNA SKIN online store. The IT system of the BOGNA SKIN webshop may also require the Customer to indicate the method of delivery (delivery by BOGNA SKIN, courier, own collection) and the method of payment (transfer, card, cash on delivery). Choosing personal collection, the Customer can pay for the order by bank transfer or using a Dotpay account.

The customer must provide the data marked with * (asterisks) in the form; failure to provide such data makes it impossible to agree on the properties of the product, and further purchase of BOGNA SKIN products within the online store. Before sending the order form, the Customer will be asked to read the Terms and Conditions and accept them.

If the data from the form sent by the Customer is sufficient for BOGNA SKIN to begin processing the order, and the product is available for sale, the Customer shall receive an e-mail from BOGNA SKIN with information about the terms of the order, including in particular: the properties of the order placed, its total price, method and date of payment, costs, and date and method of delivery. BOGNA SKIN sends the Terms and Conditions to the Customer together with the information on the terms and conditions of the order.

BOGNA SKIN sends the Terms and Conditions to the Customer together with information on the terms and conditions of the order.

The moment an order is paid for is the moment the money is credited to BOGNA SKIN’s bank account. When the order is paid for, BOGNA SKIN sends the Customer a confirmation of order completion to the e-mail address provided by the Customer, which is tantamount to confirmation of the conclusion of a distance contract for customers who are consumers. As soon as the Customer receives this e-mail, a Sales Agreement is concluded between the Customer and BOGNA SKIN. In the case of a sale in the cash on delivery option, the Customer, after sending him/her information about the terms of the order, in accordance with paragraphs 5 or 6 above, will be asked to finally accept the order. A contract of sale of BOGNA SKIN products shall be concluded when the Customer finally accepts the terms of the order.

If the data from the form sent by the Customer is not sufficient for BOGNA SKIN to begin processing the order, and especially if it is necessary to agree on individual product properties, BOGNA SKIN’s consultant shall contact the Customer to agree on all the properties of the ordered product and other terms of the order. If the Customer agrees with BOGNA SKIN’s consultant on all the properties of the ordered product and other terms of the order, the Customer receives an e-mail from BOGNA SKIN with information on the terms of the order, in particular including the properties of the order placed, its total price, method of payment, costs, and delivery date and method. BOGNA SKIN sends the Terms and Conditions to the Customer together with information on the terms and conditions of the order.

When the order is paid for, BOGNA SKIN sends the Customer a confirmation of order completion to the e-mail address provided by the Customer, which is tantamount to confirmation of the conclusion of a distance contract for customers who are consumers. In case of choosing the option of cash on delivery payment, the payment of the order is made at the latest on delivery. BOGNA SKIN will hold off on releasing the product to the Customer until the Customer fully pays for the order.

BOGNA SKIN reserves ownership of the sold products until the Customer has paid the full sales price.

VII. Purchase via e-mail

The customer can purchase BOGNA SKIN products directly via e-mail. In order to purchase BOGNA SKIN products, the customer sends an e-mail to the address: hello@bognaskin.com with an indication of the product that the customer is interested in purchasing.

Upon receipt of the Customer’s e-mail, a BOGNA SKIN consultant will contact the Customer to determine the terms of the order and the Customer’s data needed to complete it.

If the Customer agrees with a BOGNA SKIN consultant on all the properties of the ordered product and other order conditions, the Customer receives an e-mail from BOGNA SKIN with information on the order conditions, in particular including the properties of the order placed, its total price, method and date of payment, costs, and date and method of delivery. Together with the information on order conditions, BOGNA SKIN sends the Customer the Terms and Conditions together with a specimen statement of withdrawal from the remote contract. Sending a model statement of withdrawal cannot be construed as granting the right of withdrawal to a customer who is not a consumer.

A contract for the sale of BOGNA SKIN products, in the option of payment by bank transfer, is concluded when the customer pays for the order placed; in the case of advance payment / prepayment, the contract is concluded when the amount of advance payment / prepayment is paid. The moment of payment is the moment the money is credited to BOGNA SKIN’s bank account. Once the order has been paid for, BOGNA SKIN sends the Customer a confirmation of order completion to the e-mail address provided by the Customer, which is tantamount to confirming the conclusion of a remote contract in the case of customers who are consumers. The Customer may purchase BOGNA SKIN products directly by e-mail. In order to purchase BOGNA SKIN products, the Customer sends an e-mail to the address provided: hello@bognaskin.com with an indication of the product that the customer is interested in purchasing.

Upon receipt of the Customer’s e-mail, a BOGNA SKIN consultant shall contact the Customer to determine the terms of the order and the Customer’s data required for its execution.

If the Customer agrees with a BOGNA SKIN consultant on all the properties of the ordered product and other order conditions, the Customer receives an e-mail from BOGNA SKIN with information on the order conditions, in particular including the properties of the order placed, its total price, method and date of payment, costs, and date and method of delivery. Together with the information on order conditions, BOGNA SKIN sends the Customer the Terms and Conditions together with a specimen statement of withdrawal from the remote contract. Sending a model statement of withdrawal cannot be construed as granting the right of withdrawal to a customer who is not a consumer.

A contract for the sale of BOGNA SKIN products, in the option of payment by bank transfer, is concluded when the customer pays for the order placed; in the case of advance payment / prepayment, the contract is concluded when the amount of advance payment / prepayment is paid. The moment of payment is the moment the money is credited to BOGNA SKIN’s bank account. In the case of sale in the cash on delivery option, the Customer, after sending him information about the terms of the order, in accordance with paragraph 3 above, will be asked for final acceptance of the order. The contract of sale of BOGNA SKIN products is concluded when the Customer finally accepts the terms of the order. By accepting the terms of the order, the Customer who is a consumer confirms that he or she knows that the order entails an obligation to pay.

In the case of choosing the cash on delivery option, payment of the order is made at the latest upon delivery. BOGNA SKIN shall withhold the product from the Customer until the Customer fully pays for the order.

In the case of cash on delivery, the Customer shall be asked to finally accept the order after the Customer has been informed of the terms of the order in accordance with section 3 above. The contract of sale of BOGNA SKIN products shall be concluded at the moment of final acceptance of the order conditions by the Customer. By accepting the terms of the order, the Customer who is a consumer confirms that he or she knows that the order entails an obligation to pay.

In the case of choosing the cash on delivery option, payment of the order is made at the latest upon delivery. BOGNA SKIN shall withhold the product from the Customer until the Customer fully pays for the order.

BOGNA SKIN reserves ownership of the sold products until the Customer has paid the full sales price.

VIII. Order processing time and delivery

The execution of an order for the Customer starts on the first working day after the date of concluding the contract of sale of BOGNASKIN products.

The order completion date is given in the product card. In case of products available in the warehouse or BOGNASKIN stores, the lead time is from 3 to 7 working days. In case of products imported under individual customer’s order, the lead time is longer and can be from 2 to 12 weeks.

If BOGNA SKIN is unable to complete an order for a configured Product, even if it is temporarily impossible to complete the service, BOGNA SKIN may release itself from the order by offering the Customer the purchase of a replacement product corresponding to the same quality and purpose and for the same price or remuneration. The Customer has the right not to accept the replacement product and to withdraw from the contract with BOGNA SKIN.

BOGNA SKIN will inform the Customer of the unavailability of the product, a proposal to supply a replacement product, and the Customer’s right to withdraw from the contract. The Customer may withdraw from the contract within 14 days of BOGNA SKIN’s notification, according to the terms of the preceding sentence.

BOGNA SKIN will notify the Customer of the completeness of his or her order if the circumstances referred to in sections 3 to 4 above do not occur. If the Customer has not paid the full price or has not agreed otherwise within 7 days of being notified of the completeness of an order, BOGNA SKIN shall, within 7 days, make a surcharge on the full sales price of the product; BOGNA SKIN shall inform the Customer of the obligation and date of the surcharge together with a notification of completeness.

After the Customer’s surcharge has been credited, pursuant to section 5 above, BOGNA SKIN will contact the Customer to arrange delivery. The Customer shall make an appointment for delivery within 7 calendar days. The delivery date shall be confirmed by BOGNA SKIN by e-mail.

If the Customer does not receive the goods, BOGNA SKIN shall notify the Customer of the non-delivery of the goods and set a deadline for delivery or receipt of the goods, as agreed upon in the delivery arrangements. If the goods are not received by the deadline set by BOGNA SKIN, BOGNA SKIN will store the goods at the Customer’s expense and risk for a period of 3 (three) months, unless the Customer agrees another deadline with BOGNA SKIN. In such case, BOGNA SKIN will also be entitled to charge additional costs associated with delivery failure and storage costs. In the case of contracts not concluded with consumers, the cost of storage is PLN 20 for each commenced week of storage.

If the Customer does not confirm the final delivery date with BOGNA SKIN or is delayed in acceptance at the final date, BOGNA SKIN shall be entitled to withdraw from the contract within 1 (one) month of the final delivery date. For contracts not concluded with consumers, if BOGNA SKIN does not exercise its right to withdraw from the contract and 3 (three) months from the final delivery date, failure to collect the goods shall be deemed a wish to abandon them with the intention of disposing of ownership, as a result of which ownership of the goods shall pass to BOGNA SKIN, and the Customer shall waive any claims against BOGNA SKIN relating to the purchase and acquisition of the goods.

IX. Complaints and guarantees

BOGNA SKIN is liable to its customers for product defects in accordance with the Civil Code.

Using the warranty, the Buyer may, under the terms and within the periods specified in the Civil Code: Submit a declaration of price reduction, in the case of a significant defect – submit a declaration of withdrawal from the contract, demand replacement of the item with a defect-free item, demand removal of the defect. The Seller is released from liability under warranty if the customer knew about the defect at the time of concluding the contract.

The Customer may not withdraw from the contract if the defect is insignificant

If it is necessary to assess physical defects, the Goods should be delivered to the address: Bogna Skin sp. z o.o., Tumlin Podgród 52a, 26-085 Miedziana Góra

Any comments and objections concerning the operation of the online store, and in particular complaints about BOGNA SKIN products, should be reported by sending an e-mail with a description of the defect to the address: hello@bognaskin.com or in writing to the address: Bogna Skin sp. z o.o., Tumlin Podgród 52a, 26-085 Miedziana Góra. Product complaints should include an indication of the nature of the defect, the time of its detection and the customer’s request.

BOGNA SKIN shall immediately send a confirmation of receipt of the complaint to the e-mail address provided by the Customer.

A complaint submitted by a Customer shall be considered and responded to by BOGNA SKIN within 14 days of the date of submission, after clarification of all the circumstances of the complaint. To this end, BOGNA SKIN may turn to the Customer to provide additional explanations and supplement the complaint if the information contained by the Customer in the complaint is not sufficient for BOGNA SKIN to recognize the complaint.

If a complaint concerns a product, in order for BOGNA SKIN to consider the complaint, the Customer shall deliver or send the product complained about to the address of BOGNA SKIN Warehouse: BOGNA SKIN Sp. z o.o. Tumlin-Podgród 52a, 26-085 Miedziana Góra.

There is no obligation to provide or lend replacement goods to the Customer for the time of complaint processing.

In the event of a dispute related to a sales contract concluded with BOGNA SKIN, including primarily complaints, a consumer Customer who is a consumer has the option of using an out-of-court method for handling complaints and pursuing claims, including before the Permanent Consumer Arbitration Courts, in accordance with the rules governing proceedings before selected institutions/courts. BOGNA SKIN shall be liable to Customers for product defects in accordance with the Civil Code.

Using the warranty, the Buyer may, under the terms and within the periods specified in the Civil Code: Submit a declaration of price reduction, in the case of a significant defect – submit a declaration of withdrawal from the contract, demand replacement of the item with a defect-free item, demand removal of the defect. The Seller is released from liability under warranty if the customer knew about the defect at the time of concluding the contract.

The Customer may not withdraw from the contract if the defect is insignificant

If it is necessary to assess physical defects, the Goods should be delivered to the address: Bogna Skin sp. z o.o., Tumlin Podgród 52a, 26-085 Miedziana Góra

Any comments and objections concerning the operation of the online store, and in particular complaints about BOGNA SKIN products, should be reported by sending an e-mail with a description of the defect to the address: hello@bognaskin.com or in writing to the address: Bogna Skin sp. z o.o., Tumlin Podgród 52a, 26-085 Miedziana Góra. Product complaints should include an indication of the nature of the defect, the time of its detection and the customer’s request.

BOGNA SKIN shall immediately send a confirmation of receipt of the complaint to the e-mail address provided by the Customer.

A complaint submitted by a Customer shall be considered and responded to by BOGNA SKIN within 14 days of the date of submission, after clarification of all the circumstances of the complaint. To this end, BOGNA SKIN may turn to the Customer to provide additional explanations and supplement the complaint if the information contained by the Customer in the complaint is not sufficient for BOGNA SKIN to recognize the complaint.

X. Withdrawal from the sales contract

BOGNA SKIN observes the rights of consumers related to the right of withdrawal from the contract of purchase of BOGNA SKIN products, in accordance with applicable laws, and in particular, in accordance with the provisions of the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2019, item 134 as amended; hereinafter: “Act on Consumer Rights”).

BOGNA SKIN informs, in particular, that according to art. 27 and n. The Act on Consumer Rights, a Customer who is a consumer has the right to withdraw from a contract concluded remotely or off-premises without giving any reason within 14 days from the date on which the Customer who is a consumer or a third party other than the carrier of BOGNA SKIN’s products takes possession.

The right of withdrawal expires after 14 days from the date on which the product BOGNA SKIN becomes available to a Customer who is a consumer or a designated third party other than the carrier. If the contract includes multiple BOGNA SKIN products that are delivered separately, in batches or parts, the withdrawal period is calculated from the date on which the last BOGNA SKIN product, batch or part is taken into possession. 4th In order to exercise the right of withdrawal, the customer who is a consumer shall inform BOGNA SKIN of his decision by an unequivocal statement.

In order to meet the deadline to withdraw from the contract, it is sufficient to send information regarding the exercise of the Customer’s right of withdrawal before the end of the deadline to withdraw from the contract.

Please note that the right to withdraw from the contract is not available to the Customer in relation to the contracts specified in Article 38 of the Act of 30 May 2014 on consumer rights, including in relation to the contract:

a) in which the subject of performance is an item that is rapidly deteriorating or has a short shelf life,

b) in which the object of the service is an item delivered in sealed packaging which cannot be returned for health protection reasons or for hygienic reasons if the packaging was opened after delivery.

In case of withdrawal from the contract, it is considered not concluded. BOGNA SKIN shall return all payments received to the Customer, except for the cases specified in Sec. 7 below. The provisions of the Act on Consumer Rights shall apply to GREAT SKIN’s settlement with the Customer.

In case of withdrawal from the contract, it is considered not concluded. BOGNA SKIN shall return all payments received to the Customer, except for the cases specified in Sec. 7 below. The provisions of the Act on Consumer Rights shall apply to BOGNA SKIN’s settlement with the Customer.

If the Customer has chosen a method of delivery of BOGNA SKIN’s product other than the cheapest usual method of delivery offered by BOGNA SKIN, BOGNA SKIN shall not be obliged to reimburse the Customer for the additional costs incurred.

In the event of withdrawal, the Customer who is a consumer shall return the BOGNA SKIN product immediately to the address of BOGNA SKIN Sp. z o.o. Tumlin-Podgród 52a, 26-085 Miedziana Góra, no later than 14 days from the date of withdrawal. A customer who is a consumer shall bear the direct costs of returning the product to BOGNA SKIN.

Please send the Goods back to the address: BOGNA SKIN Sp. z o.o. Tumlin-Podgród 52a, 26-085 Miedziana Góra immediately, and in any case no later than 14 days from the day on which we were informed about the withdrawal from the sales contract.

If it is necessary to return funds for a transaction made by the Buyer with a payment card, the Seller shall return them to the bank account assigned to the Buyer’s payment card.

XI. Exceptions to the right of withdrawal

The Seller points out in particular that for some products (especially cosmetic products), as indicated below, it may not be possible to return them (i.e. to withdraw from the contract) due to a specific expiry date or to open them after delivery – in the case of products delivered in sealed packaging, for health protection or for hygienic reasons.

The right to withdraw from a distance contract shall not apply to the Consumer with regard to the contract:

where the subject of the service is an item produced on individual order and adjusted to individual needs.
The right to withdraw from a distance contract shall not apply to a contract: where the subject of the service is an item delivered in a sealed package and was opened after delivery. After opening the package, it cannot be returned for health protection reasons or for hygienic reasons if the package was opened after delivery.

The right to withdraw from a contract concluded at a distance shall not be vested in an entity other than the Consumer. The Seller points out in particular that in the case of some products (especially cosmetic products), according to what has been indicated below, it may not be possible to return them (i.e. to withdraw from the contract) due to a specific expiry date or to open them after delivery – in the case of products delivered in sealed packaging, for health protection or for hygienic reasons.

The right to withdraw from a distance contract shall not apply to the Consumer with regard to the contract:

where the subject of the service is an item produced on individual order and adjusted to individual needs.
The right to withdraw from a distance contract shall not apply to a contract: where the subject of the service is an item delivered in a sealed package and was opened after delivery. After opening the package, it cannot be returned for health protection reasons or for hygienic reasons if the package was opened after delivery.

An entity other than the Consumer shall not be entitled to withdraw from a contract concluded at a distance.

XII. Personal data

BOGNA SKIN processes the Customers’ personal data in accordance with the provisions of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Regulation on the Protection of Personal Data), hereinafter referred to as “FAMILY”, and the provisions of the Act of 10 May 2018. on the protection of personal data (Journal of Laws, item 1000), as well as in accordance with the provisions of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2019, item 123, as amended).

The rules for BOGNA SKIN’s processing of the Customer’s personal data necessary to provide services through the online store, and in particular to establish, shape the content, change or dissolve the legal relationship between BOGNA SKIN and the Customer, as well as those resulting from the properties of the services provided by BOGNA SKIN (basic data), including name, surname, company, address of residence, address of the place of business activity (registered office), address for correspondence if different from the place of residence or business activity, as well as electronic addresses, are governed by BOGNA SKIN’s Privacy Policy.

The Customer consents to the processing of the data concerning him or her referred to in paragraph 2, which are not personal data within the meaning of Art. 4(1) of the TYPE.

The Customer may withdraw his or her consent to the processing of basic data at any time, and in the case of personal data, if the processing of the Customer’s personal data is based on the consent given. The Customer may at any time object to the processing of personal data concerning him/her, pursuant to Art. 22 of the GCU.

The Customer has constant and unrestricted access to the data provided to BOGNA SKIN, including personal data, and may change, supplement, rectify, and exercise other rights granted to him/her pursuant to TYPE, with respect to the processing of his/her personal data by BOGNA SKIN.

Once the service has been provided, BOGNA SKIN may process it:

the data of the customer of the online store, which are not personal data, especially those that will be necessary to clarify the circumstances of using the functionality and services of the online store contrary to the Regulations;
the personal data of the Customer of the online store in accordance with the rules resulting from the TYPE and other generally applicable regulations and the Privacy Policy.

The administrator of the personal data is BOGNA SKIN, which secures them in accordance with the generally applicable regulations, including the TYPE.

BOGNA SKIN makes every effort to ensure that the online store is available at all times and that services are provided to the Customer with due diligence. The above statement does not constitute a promise by BOGNA SKIN within the meaning of Article 391 of the Civil Code.

BOGNA SKIN is entitled to temporarily suspend the online store’s availability, particularly in the event of the need to carry out repairs or maintenance of the store’s operating systems, and in connection with the need to upgrade or expand them.

When registering and setting up an account, the Customer is obliged to keep the password to access the account secret. The password constitutes confidential information, to the exclusive knowledge of the Customer.

The Customer is obliged to establish the password in a way that makes it impossible for third parties to guess it. The password must contain minimum 6 characters.

The Client is responsible for making the password available to third parties.

All activities, especially those which will result in BOGNA SKIN undertaking and/or performance of certain services for the Customer, and which will be undertaken as a result of their order using the Customer’s account, shall be presumed to have been undertaken directly at the Customer’s request. The Customer may be held liable for any damage caused by the Customer as a result of BOGNA SKIN undertaking such actions as a result of their assignment by an unauthorized person, not attached or exceeding the scope of authorization.

XIII. Final provisions

The Regulations shall enter into force on 01 June 2020.

BOGNA SKIN ‘Vendor’ reserves the right to change these Regulations. Amendments to the Regulations do not apply to the conditions of performance of contracts concluded before the date of entry into force of the amendment, unless the law provides otherwise. Changes to the Regulations are made by publishing its new content on the store’s website, with prior notification of this fact. The information about the change of the Regulations shall be placed in the area of the store’s website, not later than 10 days before the date of its coming into force.

All rights to the content of the online store as a whole, including its layout and appearance, are reserved for BOGNA SKIN, and the rights to its individual text elements, photographs, graphics, applications, interfaces, databases, contract templates, individual solutions and constructions are reserved for BOGNA SKIN or, respectively, for entities whose content is made available on the website of the online store on the basis of separate agreements with BOGNA SKIN.

Using the content and functions of the online store by the Customer does not mean that the Customer acquires any rights on intangible assets to the works contained therein; the Customer may use these works only to the extent permitted by the Act of 04 February 1994 on Copyright and Related Rights (i.e. Journal of Laws of 2019, item 1231 as amended).

In other matters not regulated by the provisions of these Regulations, relevant provisions of Polish law shall apply.

The Customer has the possibility to use out-of-court methods of examining complaints and pursuing claims resulting from orders placed in the Store. These include: in the case of a dispute over property rights arising from contracts of sale and provision of services, applying for consideration of the case by the Permanent Arbitration Consumer Court acting at the relevant Provincial Inspectorate of Commercial Inspection; applying to the Provincial Inspector of Commercial Inspection in Warsaw (http://wiih.org.pl/) to take action to resolve the dispute out of court on the basis of the Act of 23 September 2016 on out-of-court settlement of consumer disputes (Journal of Laws of 2016, item 1823).

Regardless of paragraph 3, the Client may turn for assistance to the municipal (district) consumer advocate. All necessary information can be obtained on the website of the Office of Competition and Consumer Protection at www.uokik.gov.pl.

The Customer who is a consumer may also use the electronic way of solving disputes with the Seller through the ODR platform available at http://ec.europa.eu/consumers/odr/.

Disputes arising from the provision of services under these Regulations shall be resolved:

the common court at the Customer’s choice in accordance with the relevant provisions of Polish law, if the Customer is a consumer,
to a common court competent according to the seat of the Seller, if the Customer is not a consumer.
